Ticket Transfer and Refund Policy

All tickets are non-refundable, but are transferable. Tickets cannot be rolled over to the following year.

How to transfer your ticket:

Tickets can be transferred by contacting us through our Facebook page or by email (find both under the Contact menu).

There is a $25 transfer fee to transfer your ticket.
Ticket transfer deadline is November 15th, 2023.

Photography/Videography Policy & Release

 

Release:

By participating in Elevation Zouk Festival, you agree that your face or likeness may appear in:

 

Official Elevation Zouk Festival website, Social media platforms and Elevation Zouk Festival promotion.

 

Your image may be used for:

Promotion, marketing, print or digital materials, or in any other medium (for example, on Elevation Zouk Festival websites or other sites that promote or mention Elevation Zouk Festival, or in the creation of online albums for the event.)

You consent to being photographed or videoed by Elevation Zouk Festival media team members while in any event spaces, including the event hotel, event venues, after party and pre-party venues (for example, Iron Mountain Hot Springs), whether indoor or outdoor (for example, in venue/hotel parking lots or in venue common areas).

 

You hold no rights to any photographs, videos, or any other representations of you produced by the media team of Elevation Zouk Festival, its employees, volunteers, affiliates, or participants. You may use the photographs for personal use provided you comply with any directions for use set out by Elevation Zouk or the photographer/videographer. If you plan to use the image for self-promotion or commercial purposes, you must obtain permission from Elevation Zouk Festival and (when applicable), the photographer/videographer.

 

When you can take your own videos/photos:

You can take pictures or videos of shows, competitions, and social dancing, with the exception of any components where the subject or event specifically requests no videos or photos be taken. For example, a specific group may request no one take videos of a performance.

 

Elevation Zouk Festival will seek permission prior to posting or using any privately acquired photographs or videos, but retains the right to re-share or embed any photographs or videos publicly posted on social media without specific consent.

 

Rules about taking videos and photos:

Remember that not everyone likes having photos or videos taken and/or posted. You are responsible for ensuring that the subject of your non-official video or photo consents to appear. For example, you should ask dancers prior to (or, in some cases, immediately after) filming social dancing if they consent to having the video or photo posted. You must not post photos or videos without the consent of the subject. If any person requests you remove a photograph or video of them, you must do so as soon as

possible.

 

You should only film portions of workshops with the consent of the instructor. Most instructors will provide a recap at the end of the class for filming. Please be aware that workshops and teaching are how professionals make their living, and this is not a free online class. It is a class for Elevation Zouk Festival attendees who are seeking to learn. Any videos where instruction takes place must not be posted publicly online or otherwise shared with a network of dancers, and must be used in accordance with Fair Use legislation. This means you can do things like share it privately with a practice partner, but not post online for your whole community to learn from.

COVID-19

The event itself and the participation of international artists are subject to change depending on current government regulations and restrictions.

Right to Refuse Service

 

All participants are required to abide by our event Policies, and may be asked to leave with no refund if determined, in Elevation Zouk Festival’s sole discretion, to not comply with them. Elevation Zouk Festival reserves the right to refuse service to anyone if it finds that your participation might be dangerous or harmful to the event’s participants or event’s or its organizers’ image.

 

Event Accident Waiver and Release of Liability

 

YOU ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ELEVATION ZOUK FESTIVAL ACTIVITIES. This includes, but is not limited to, personal injuries that occur from participating in shows, social dancing, or workshops, or walking to/from the venue, effects of high altitude. You also assume any risks that may arise from negligence or carelessness on the part of the Released Parties. This includes but is not limited to any risks stemming from dangerous or defective equipment or property owned, maintained, or controlled by the Released Parties. You will assume any risks that Released Parties would be liable for without fault.

 

The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, physical or mental condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for volunteers and staff. For the purposes of this waiver, the Released Parties include: Elevation Zouk Festival, Bruno and Fae, Zouk Immersion LLC, Dance America Productions, Crowne Plaza Hotel, Iron Mountain Hot Springs, and any of their affiliates, volunteers, sponsors, staff/employees, artists, and/or their directors, officers, representatives, and agents, or any other related entities not explicitly mentioned.

 

YOU ACKNOWLEDGE that Elevation Zouk Festival involves strenuous physical and mental components, which can potentially lead to death, serious injury, or property loss.

 

YOU CERTIFY that you are physically fit to participate in Elevation Zouk Festival, and that (if required) you have sufficiently prepared or trained for participation in the activities you decide to do. You certify that there are no health-related reasons or problems which preclude your participation in this activity. You understand that you should not participate in Elevation Zouk Festival if you have been advised by a qualified medical professional that it is unwise to do so. If you have been advised not to participate in any aspect of Elevation Zouk Festival by a qualified medical professional, you take full responsibility for any issues that may arise from your participation.

 

YOU UNDERSTAND that it is your responsibility to regulate your participation in activities at Elevation Zouk Festival, including (by way of example, but not limited to) making it known if you are not comfortable or capable of performing any movements for any reason (including both mental and physical reasons). You understand that you have the right to refuse to participate in any aspect of the event, and that it is entirely your responsibility to decide whether or not to participate. You assume all risks in this regard.

 

YOU UNDERSTAND that the laws of the state of Colorado as well as the US federal laws shall govern this waiver. In the event of any dispute, this waiver will be interpreted under and according to the laws of the province of the state of Colorado.

 

YOU UNDERSTAND that if any provision or part of this waiver is found to be invalid or unenforceable, in whole or in part, such invalidity or unenforceability will attach only to the part of this waiver that is invalid or unenforceable, and that the remaining parts of this waiver will continue in full force and effect.

 

YOU ACKNOWLEDGE that this Accident Waiver and Release of Liability will be relied on by the Released Parties, and that it will govern my actions and responsibilities at Elevation Zouk Festival in regards to my participation in any and all activities. The Accident Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under Colorado and US law.

 

On behalf of yourself, my executors, administrators, heirs, next of kin, successors, and assigns as follows,

you swear the following:

 

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, the Released Parties.

 

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the Released Parties from any and all from and against all claims, damages, losses, and actions, including reasonable legal fees, arising out of damages or liabilities for bodily injury, including death, or damage to property, caused by a negligent act, strict liability, breach of contract, error, or omission of the Released Parties or any of their agents, subcontractors, or employees for any event or activity related to Elevation Zouk Festival.

 

(D) I consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity, and that if I reject any advisable medical treatment, I alone bear the responsibility for any results and all liability for that decision.

 

(E) I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT DIGITALLY OF MY OWN FREE WILL. I UNDERSTAND THAT I HAD THE OPPORTUNITY TO ASK FOR CLARIFICATION FROM ELEVATION ZOUK FESTIVAL OR MY OWN INDEPENDENT LEGAL COUNSEL.
